What does a Transfer Impact Assessment
service include?
A Transfer Impact Assessment service documents who exports and imports personal data, their roles, the data and purposes, hosting and remote access, vendors and onward transfers. For EU–MENA flows, it also connects regional operating facts to the selected GDPR transfer mechanism. It then identifies the applicable GDPR transfer mechanism, completes supporting documentation and evaluates whether contractual, organisational or technical supplementary measures are needed.
Data can move
without changing servers.
The review follows availability and access, not just the location written on a cloud invoice.
Remote support access
A MENA support, engineering or back-office team accesses data held in an EU cloud region.
A vendor changes location
A SaaS, analytics, AI, communications or hosting provider adds a new processing or support country.
Group systems centralise data
HR, CRM, finance, identity or security platforms make EU personal data available across group entities.
Four concepts.
One evidence chain.
SCCEuropean Commission clauses providing a contractual safeguard for qualifying transfers.
TIAAssessment of the transfer context and whether protection is effective in practice.
ImporterThe separate recipient in the third country receiving or accessing personal data.
MeasuresTechnical, contractual and organisational safeguards selected for the actual risks.
Every conclusion
connected to a fact.
RGPD Conseil Maroc organises the data flow, legal mechanism, practical assessment and safeguards into one maintainable file.
Exporter–importer map
Entities, establishments, roles and transfer relationships documented per processing purpose.
Data-flow inventory
Data categories, subjects, purposes, frequency, systems, storage, access and recipients recorded.
SCC module and annexes
Correct party configuration, processing details, competent authority and security measures prepared.
Transfer impact assessment
Legal and practical context, access risks, onward transfers and existing controls assessed.
Supplementary-measures plan
Encryption, key management, pseudonymisation, minimisation, access and contractual measures evaluated.
Review and change register
Triggers, owners, evidence and review dates defined for ongoing transfer governance.
From diagram
to defensible file.
Trace
Identify exporters, importers, systems, access locations and onward recipients.
Classify
Confirm roles, transfer scenarios, mechanisms and SCC configuration.
Assess
Evaluate context, risks, existing measures and additional safeguards.
Control
Approve the file, assign actions and define review triggers and ownership.
The document depends
on the relationship.
Roles and transfer facts are established before a clause or template is selected.
| Scenario | Key question | Typical output |
|---|---|---|
| EU controller to MENA processor | Does the importer process only on documented instructions? | Article 28 terms, controller-to-processor SCCs, TIA and measures. |
| EU processor to MENA subprocessor | Is the onward appointment authorised and consistent with customer commitments? | Subprocessor approval, processor-to-processor SCCs, TIA and evidence. |
| EU controller to MENA controller | Do the parties independently determine purposes or means? | Controller-to-controller SCCs, transparency inputs and allocation of duties. |
| Remote access from MENA | Which separate entity makes data available to which recipient? | Access map, transfer analysis, safeguards and control record. |
Transfer questions
answered directly.
What is an EU–MENA personal data transfer? −
A transfer scenario can arise where an exporter subject to GDPR makes personal data available to a separate importer in a MENA country. Hosting, support access, group systems, vendors and onward disclosures must be assessed using the actual roles and data flow.
Does remote access from MENA count as a transfer? +
Remote access by a separate organisation in a third country can form part of a transfer scenario even when the server remains in the EEA. The entities, roles, access rights and processing context must be documented.
Which SCC module should be used? +
The correct module depends on whether each party acts as controller or processor. The roles must be established per processing activity before selecting and completing the relevant SCC module and annexes.
What does a transfer impact assessment examine? +
A TIA examines the parties, data, purposes, destination, transfer mechanism, legal and practical context, likelihood and impact of access, onward transfers, and the effectiveness of contractual, organisational and technical safeguards.
Are encryption and pseudonymisation always required? +
Measures should be selected according to the risks and transfer context. Encryption, key control, pseudonymisation, access restriction, logging, minimisation and split processing can be relevant, but their effectiveness depends on implementation.
How often should transfer documentation be reviewed? +
Review should be triggered by material changes such as a new vendor, cloud region, access location, service purpose, category of data, onward transfer, legal development or security incident. A periodic control cycle should also be defined.
Transfer work
anchored in EU guidance.
The engagement is scoped around identified transfers, entities and systems. RGPD Conseil Maroc records the assumptions, evidence, decisions and actions so the file can be reviewed when the processing chain changes.
